Sotheby’s auction house has earned renown as a marketer for many of the world’s most valuable and prestigious possessions for more than 260 years. Scott Franklund, an agent with the Boulder office of Sotheby’s International Realty, has embraced his affiliation with the coveted Sotheby’s auction house and chosen the sophisticated auction method as a cutting-edge manner for serving his high-end sellers. Franklund, known for representing buyers and sellers of extraordinary luxury real estate throughout Colorado, would like to present to you his Sotheby’s Fall 2008 Luxury Real Estate Sealed Bid Auction. The Fall Auction will offer buyers an unprecedented assemblage of motivated sellers throughout Colorado. These luxury estates and ranches will be sold to the highest bidder.

Most homes will be available for viewing on dedicated Sundays throughout September and October, or by private appointment. During these times we welcome prospective buyers to view the properties and embrace the outstanding lifestyles offered for sale. Documents relating to the properties (such as surveys, floorplans, inclusions and exclusions, reports, etc) will be available in the Seller Packets in the homes, on our website within the property pages or by request.

BUYER GUIDELINES:

  • Buyer agrees and understands that it is bidding on real estate and submitting a Sales Contract that binds them to a closing if a winning offer is submitted.
  • Buyers who submit an offer are doing so only after they have reviewed and are comfortable with the information included in the seller packet and have completed any studies they wish on the home.
  • When Buyer submits an offer, Buyer is agreeing to perform.
  • Buyer can submit an offer in writing on our Sales Contracts any time prior to date specified as close of auction.  Such Contracts can be downloaded from our official website.
  • Offers must begin at the minimum bid price.
  • With the offer, Buyer must submit a check for 5% of the offered purchase price which shall be considered non-refundable down payment if they are the winning bidder.
  • Buyer shall additionally submit a contact person (legal counsel, certified public accountant or financial representative) who can be reached at time of opening sealed bids able to confirm Buyer’s capacity to perform a successful closing within 30-days.
  • Buyer understands that Seller has the option to withdraw the property from the auction process prior to end of auction if a contract is accepted in a traditional method.
  • Buyers are welcome to bring agents and have representation. If the Buyer chooses to use his own broker,said documentation must be submitted in writing on or before the offer itself.  
  • Buyers shall be responsible for the cost of title insurance and any studies they seek beyond what is included in the seller package. 
  • All homes shall be sold as-is, without contingencies. 
  • Buyers may contact Scott Franklund of Legendary Properties Sotheby’s International Realty to view any homes by appointment or on the Sundays designated via the advertising.
  • If a tie occurs at the conclusion of the auction where each bid is above the minimum bid, the first bid received is the winning bid. If two bids are simultaneously received (by mail or FedEx on the same day), we will call the winners and give each 24 hours to submit another bid.
  • Closings shall occur 7 days from notification of winning bid or within 30-days from notification. No closings shall be accepted post November 17, 2008.


THE SEALED BID SUBMITTAL PROCESS SHALL CONSIST OF THE FOLLOWING DOCUMENTS:

  • Bid Form
  • Colorado Contract to Buy and Sell Real Estate
  • 5% Deposit
  • Contact name and information to verify Buyer's capacity to perform
  • Broker Registration, if applicable

Please note: A bid will not be considered valid without full execution and submission of all above documents.

Legendary Properties Sotheby’s International Realty has chosen the law firm of Frascona, Joiner, Goodman and Greenstein to accept the sealed bids on their behalf. The deadline for sealed bids to arrive at the law firm is October 15, 2008 at 5:00pm. The address for submittals is as follows:
